The EEOC, DOL, and NLRB Joint Commission: What is it and What Does it Mean?

The Equal Employment Opportunity Commission (the “EEOC”), the Department of Labor (the “DOL”), and the National Labor Relations Board (the “NLRB”) announced a joint commission tasked with enforcing workplace laws relating to retaliation in the workplace. The Memoranda of Understanding (the “MOU”) between the three federal agencies allows all three agencies to share information and investigate charges that violate multiple laws. This is the first time ever that three federal agencies have announced a joint initiative and therefore, it is too soon to tell what employers can expect as a result of the joint initiative.  However, employers should generally expect increased resources regarding retaliation in the workplace and compliance.  Additionally, employers may also experience more aggressive enforcement activities by the three agencies.
