  • Tenth District Court Of Appeals Finds The Commission Did Not Err In Relying On Vocational Assessment That Failed To List All Of The Claimant’s Restrictions

    In State ex rel. Lacroix v. Indus. Comm., 10th Dist. No. 12 AP-931, 2013-Ohio–4881, The Commission denied the claimant’s PTD application, relying in part on a vocational report which failed to list all the claimant’s medical restrictions.  The claimant challenged the Commission’s decision in mandamus action, arguing it was error to rely on the incomplete vocational report.

  • OSHA Proposes New Rule to Publish Injury and Illness Data Online

    On November 7, 2013, OSHA announced a proposed rule which, for the first time, will require employers to submit electronically injury and illness data currently recorded on OSHA Forms 300 and 301. OSHA has scheduled a public hearing for January 9, 2014, to discuss this proposed requirement.  Employers have until February 6, 2014 to submit written comments on the proposed rule.  Click here to read more.

    Court of Appeals Finds Commission’s Disability Determination Flawed
    In  State ex rel. Staples The Office Superstore East, Inc. v. Indus. Comm.,  2013-Ohio-4339, the 10th District Court of Appeals found the Commission abused its discretion by granting temporary total disability compensation (TTC), where the treating doctor’s chart notes showed he was treating the claimant for a non-allowed low back condition.
    The claim was allowed for lower leg conditions.
