  • Court of Appeals Finds Commission Properly Allocated PTD Award

    In State ex rel. Cafaro Mgmt. Co. v. Indus Comm., 2013-Ohio-5104, the Commission allocated a PTD award between two separate claims, finding each claim contributed to the claimant’s permanent disability.  Although the court’s magistrate found the Commission failed to explain the allocation adequately, the court upheld the Commission’s order because there was some evidence to support the order.  Read the full decision here.

  • Court Of Appeals Denies Chiropractic Treatment

    In State ex rel. Almendinger v. Indus. Comm, 2013-Ohio-5103, the 10th District Court of Appeals found the Commission properly denied a claimant’s request for chiropractic treatment, where the chiropractor failed to relate the treatment to the claim allowances.  The court’s magistrate recommended reversal of the Commission’s decision, in part, because the Commission did not mention the chiropractor’s report in its order.

    U.S. Senate Passes “ENDA”
    On November 7, 2013, and by a bipartisan vote of 64 to 32, the U.S. Senate passed the Employment Non-Discrimination Act of 2013 (ENDA).  If enacted, this law would amend Title VII of the 1964 Civil Rights Act by including in its protections a prohibition against employment decisions based upon a person’s “sexual orientation or gender identity.
