  • Bugbee & Conkle Successful in Ohio Supreme Court in Limiting Employer Intentional Tort Liability under R.C. 2745.01

    On December 18, 2014, the Ohio Supreme Court issued a much awaited decision in Pixley v. Pro-Pak Industries, an intentional tort case.  The Court held establishing an intentional tort requires evidence that the employer deliberately intended to cause harm to an employee.  The court declined to address whether an equipment safety guard is limited to a device shielding only the operator from injury.

  • New PTD Rules Becomes Effective December 15, 2014

    On December 15, 2014, the amendments to Ohio Admin.Code 4121-3-34 (the permanent total disability rule) became effective.  As a practical matter, the amendments are minor, as only one section of the rule has changed.

  • OSHA Guidance for Occupational Exposure to Ebola Virus

    The Ebola virus is a potential hazard for workers whose jobs involve healthcare, mortuary and death care, airline and other transportation operations, cleaning and environmental services, and certain law enforcement services. Based on existing OSHA as well as Center for Disease Control and Prevention findings, OSHA has released a new factsheet to assist employers in selecting appropriate protective equipment for workers who may be exposed to the Ebola virus.
