  • Effect of Legalization of Same Sex Marriage on Employment Laws to be Discussed at Employment Law Seminar

    The United States Supreme Court’s decision in Obergefell v. Hodges, legalizing same sex marriage, is now well known. Bugbee & Conkle’s annual Employment Law seminar, scheduled for October 1, 2015, will include consideration of the impact of this decision on a number of different employment laws, including the FMLA, ERISA, the ADAAA, and Ohio’s workers’ compensation laws, just to mention a few.  Registration for the seminar will begin in mid-July.

  • Tripping and Falling Over Untied Shoelaces

    In a decision issued on June 19, 2015, in Lafon v. Iron Tiger Logistics, the Second Appellate District Court addressed the critical element of compensability concerning causal relationship to employment.  Lafon worked as a “yard man” at Iron Tiger Logistics where new trucks are transported to various locations nationwide.  He was responsible for moving trucks to their ready position and then moving finished products to their assigned places in the yard.

  • OSHA Issues Guidance on Transgender Workers and Restroom Access

    OSHA requires employers to provide all employees with sanitary and available toilet facilities under the sanitation standard 1910.141.  On June 1, OSHA published “A Guide to Restroom Access for Transgender Workers,” which was developed at the request of the National Center for Transgender Equality.  The core principle underlying this publication is that all employees, including transgender employees, should have access to restrooms which correspond to their gender identity.
