Commission Clarifies Hearing Officer Manual Memo I5

Effective June 18, 2014, the Commission revised Hearing Officer Manual Memo I5, which addresses the processing of compensation during the pendency of a court appeal pursuant to R.C. 4123.512.  The revisions seek to clarify the processing of permanent partial disability compensation, scheduled loss awards, and awards for impaired earning capacity.  Through the policy memo, the Commission has taken the position that the above forms of compensation shall not be processed during a court appeal unless it is the employer’s appeal and said employer consents to dismissal, or, if it is the claimant’s appeal and the request for compensation applies to an allowed condition in the claim.  Click here to review the policy memo.
