Commission Proposes Amendments to Rules

The Commission has proposed amendments to two of its administrative rules: Ohio Admin.Code 4121-3-18 (Administrative Appeals) and Ohio Admin. Code 4121-15-03 (Standard of Conduct for Bureau and Commission employees).

The proposed amendment to Ohio Admin.Code 4121-3-18(B)(4) amends an appealing parties’ appeal deadline for parties electing to receive orders electronically.  Presently, there is a rebuttable presumption that a party who receives email notification of orders receives the order on the next business day after the date the email notification was sent by the Commission.  Under the amendment, the party will have 3 days after the date of mailing of the order.  The proposed amendment to Ohio Admin.Code 4121-3-18(B)(4) can be found here.

Under Ohio Admin. Code 4121-15-03, hearing officers are prohibited from receiving compensation for personal services rendered on a matter before the Bureau or  Commission, or from accepting anything of value from anyone doing business with the Bureau or the Commission.    The amendment seeks to clarify what is meant by “anything of value” and “compensation.”  Under the amendment, “value” means worth greater than de minimis or nominal; “compensation” means money, thing of value, or financial benefit.  The proposed amendment to Ohio Admin.Code 4121-3-18 can be found here.
