New PTD Rules Becomes Effective December 15, 2014

On December 15, 2014, the amendments to Ohio Admin.Code 4121-3-34 (the permanent total disability rule) became effective.  As a practical matter, the amendments are minor, as only one section of the rule has changed.  Section (C)(6)(a)(i) of the rule, which addresses the time frame for filing an objection to a tentative order awarding PTD compensation, was amended to permit a party to file a written request to change the start date or allocation of PTD compensation within 30 days of receipt of the tentative order adjudicating the merits of the PTD application.  All other sections of the PTD rule remain unchanged.  Click here to review the rule on the Commission’s website.
