New Wage Loss Rules Effective February 13, 2014

On February 13, 2014, the new wage loss rules became effective.  Although the new wage loss rule is not a significant departure from the old rule, the old rule was rescinded because of the number of changes contained in the new rule.  Of note, the new wage loss rule, which is codified at Ohio Admin.Code 4125-1-01, enhances the definition section and is now alphabetized.  In addition, the rule contains separate paragraphs setting forth the prerequisites for receiving working and non-working wage loss compensation, provides guidelines for on-line job searches, and sets forth exceptions to the requirement to supplement a job search for claimants applying for or receiving working wage loss compensation.  Click here to review the new rule.  We will provide a more in depth summary of the rule change in the March Comp Connection.
