On July 15, 2014, OSHA issued a Policy Memorandum to its Regional Administrators explaining in greater detail the Temporary Worker Initiative launched April 29, 2013. The purpose of the memorandum is to clarify responsibilities of staffing agencies and host employers with respect to temporary workers. OSHA considers the staffing agency and the host employer to be “joint employers” of temporary workers, and will hold both employers responsible for protecting the safety and health of the temporary worker. In light of OSHA’s recent enforcement actions with respect to temporary employees, it is imperative that both host employers and staffing agencies communicate and assess their obligations and responsibilities.
