When a Workers’ Compensation Claim Morphs into ADA and FMLA

The majority of workplace absences are related to the illness of employees or their family members. When an employee is injured or ill, workers’ compensation, Americans with Disabilities Act (ADA), and the Family Medical Leave Act (FMLA) all have the potential to be involved. If more than one of these laws are involved, it is even more difficult for HR professionals to navigate the claim. Violations of these laws may result in lost wages, back pay, reinstatement, retroactive benefits, compensatory or punitive damages, etc.
