Humana Sues Farmers Insurance For Alleged Violation Of Medicare Secondary Payer Practices

Humana, Inc., an insurance company which provides Medicare Advantage plans and Part D prescription plans, sued Farmers Insurance in several Federal District Courts, alleging Humana was entitled to reimbursement for benefits Humana paid under these plans as a secondary payer of health benefits.  Humana alleges the Medicare Secondary Payer Act permits entities such as Humana to receive reimbursement from primary payers in the same manner the Center for Medicare and Medicaid Services receives reimbursement.  Because reimbursement issues under the Medicare Secondary Payer Act affect workers’ compensation settlements, the outcome of these lawsuits may affect workers’ compensation settlements.  Click here to read more about this story.  Click here to read the Complaint filed in the United States District Court for the District of Kansas.
