Employment handbooks must evolve with rapid technological developments necessitating company policies on employee use of social media. Employment handbook policies should be clear on when and how employees can and cannot use social media and “bring your own device” technology. Employers should also be aware that the National Labor Relations Board (NLRB) has pursued employment handbook policies with a vengeance the past year or two. The NLRB has focused on policies which might restrict employee right to engage in protected concerted activity. Employer policies should balance the need to protect confidential business information with employee right to engage in concerted activity.
